Terms of Service

These Terms of Service govern your use of this website and any event services booked with The Purple Drank, a mobile daiquiri trailer and bar service located at 941 Bourbon St, New Orleans, LA 70116. By using this site or requesting a booking, you agree to these terms.

1. Age Requirement

You must be 21 years of age or older to use this site, to purchase alcoholic beverages, or to book alcohol service. Louisiana law sets the lawful drinking age at 21, and we card. Any attempt to misrepresent your age or to obtain alcohol for a person under 21 is a violation of Louisiana law and of these terms.

2. Bookings, Deposits, and Payment

A submitted inquiry is a request, not a confirmed booking. Your date is held only once we deliver a written quote or event agreement and you pay the required deposit. Deposits are non-refundable unless stated otherwise in writing, because a held date takes the trailer off the market. Remaining balances are due as stated in your event agreement. Prices shown on this site are starting estimates and may change based on travel, hours, staffing, guest count, and permit requirements.

3. Cancellations, Reschedules, and Weather

Cancellation and reschedule terms are set out in your event agreement. Because we operate an outdoor trailer, severe weather, flooding, street closures, parade routes, or an official emergency declaration may make service unsafe or impossible. In those cases we will work with you to reschedule where reasonable. We are not liable for losses caused by events beyond our reasonable control.

4. Client Responsibilities at the Venue

The client is responsible for securing lawful access to the event site, including parking or placement space for the trailer, level ground, reasonable clearance, and any venue approval or private property permission we need. The client must disclose in advance any venue rule, HOA rule, or permit condition that affects alcohol service. If the site is unusable on arrival and no alternative is available, the event may be treated as a same-day cancellation.

5. Alcohol Service and Responsible Service

All alcohol service is performed by our permitted staff in accordance with Louisiana law and the rules of the Louisiana Office of Alcohol and Tobacco Control. Our staff will check identification, may refuse or discontinue service to any guest who appears intoxicated or cannot produce valid ID, and may stop service entirely if guest conduct becomes unsafe. Guests may not bring their own alcohol into our service area, and alcohol we serve may not be resold. Service refusals made in good faith are not grounds for a refund.

Where a client requests a service arrangement that we cannot lawfully provide at a given location, we may substitute an alcohol-free service or cancel that portion of the event.

6. Assumption of Risk and Liability

To the fullest extent allowed by Louisiana law, our total liability arising out of an event is limited to the amount you paid us for that event. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited under Louisiana law, including liability for gross negligence or intentional misconduct.

Under Louisiana Revised Statutes 9:2800.1, the consumption of alcoholic beverages, rather than their sale or service, is the proximate cause of any injury inflicted by an intoxicated person over the age of 21. Each guest is responsible for their own consumption and conduct.

7. Indemnity

The client agrees to indemnify and hold us harmless from claims arising out of the client's or its guests' conduct at an event, misrepresentation of guest ages, violation of venue rules, or breach of these terms, except to the extent caused by our own fault.

8. Photography and Media

We may photograph or record our trailer and service at public and private events and use those images to promote the business. Tell us in writing before your event if you prefer that we not do so at your event.

9. Website Use and Intellectual Property

The name The Purple Drank, our logo, photographs, and site copy are our property and may not be copied or used commercially without written permission. You agree not to misuse the site, submit false information through our forms, or attempt to disrupt the service.

10. Governing Law and Venue

These terms are governed by the laws of the State of Louisiana, without regard to conflict of law rules. Any dispute shall be brought exclusively in the state or federal courts located in Orleans Parish, Louisiana, and both parties consent to that venue.
